Terms of Use

1.1The IsraModel AI website ("the Site") is operated by the business IsraModel AI ("the Business").

1.2Using the Site constitutes full and unconditional acceptance of all of these terms. A user who does not agree to the terms is asked not to use the Site.

1.3The service is intended for users aged 18 and over only.

1.4The Business reserves the right to update, change, expand or reduce the service, the prices, the plans and the terms, subject to these terms.

1.5The Business may suspend or discontinue the operation of the Site, in whole or in part, temporarily or permanently.

2.1Full use of the service requires registering and opening a personal account.

2.2The user undertakes to provide correct, complete and accurate details.

2.3The user is responsible for keeping their login details safe and may not pass them on to any third party.

2.4The Business may suspend or close an account if these terms are breached or the Site is used improperly.

3.1The Site provides a service for creating images, videos and visual content using artificial intelligence.

3.2The Business does not guarantee any particular result, style or quality, or that results will match the user’s expectations.

3.3The service is provided as is, and changes, faults, bugs or unavailability may occur from time to time.

3.4The Site is not a storage service, and the Business does not undertake to keep outputs for any period of time.

4.1Use of the service is paid for through monthly or annual subscriptions and/or the purchase of credits (called "tokens" in the Hebrew version).

4.2The Business may update the prices of the service, the structure of the subscriptions and the credit cost of usage from time to time. Such changes apply to new purchases or future billing periods only. If a material change affects an active subscription, notice will be given in advance by reasonable means.

4.3Credits granted as part of a monthly subscription do not accumulate and do not carry over to the next month.

4.4Credits not used during the subscription period expire, and no refund, credit or transfer will be given for them.

4.5A subscription renews according to the terms of the subscription the user purchased, including recurring charges where set up.

4.6The Business may discontinue or change any package, plan or benefit.

4.7A subscription renews every month until the user cancels it, and the user is responsible for keeping a valid payment method on file. A monthly charge that fails for any reason (including a card that has expired, been blocked or been declined) while the subscription has not been cancelled does not release the user from payment: the user remains liable for full payment for every month in which the subscription was active. The Business will notify the user of a failed charge, and may retry the charge and collect the unpaid months retroactively, including through an updated payment method. If payment is not settled within two months of the first failed charge, the Business may suspend or end the subscription. Cancelling the subscription does not release the user from payment for months in which the subscription was already active.

5.1The service is provided digitally only, through the Site.

5.2Access to the service is given immediately once the payment is approved.

5.3The Business is not responsible for loss of outputs, storage failures, network disruptions or third-party faults.

6.1It is strictly forbidden to use the Site to create offensive or illegal content, or content that infringes the rights of others.

6.2It is forbidden to use the Site for:

• Impersonating another person
• Creating images of real people without their full permission
• Creating characters identifiable with a famous person without approval
• Using outputs for fraud, deception, defamation or invasion of privacy
• Creating sexual, pornographic, violent or hateful content
• Creating content that infringes copyright, trademarks or rights of publicity

6.3It is forbidden to run scripts, bots or automated systems, or to attempt intrusion or load testing.

6.4Reverse engineering, attempting to probe the models or extracting internal information from the Site is strictly forbidden.

6.5The Business may block or delete an account immediately because of prohibited use.

6.6The user undertakes not to create, upload or use outputs based on the likeness of a real person, private or famous, without full and clear permission from that person.

6.7All legal responsibility for using the likeness of a real person lies with the user alone.

6.8The Business is not responsible for any complaint, damage or claim arising from the use of an output based on the likeness of a real person without consent.

6.9It is forbidden to upload to the Site materials for which the user does not hold full rights and permission to use.

6.10It is forbidden to request the creation of a character resembling, inspired by or based on a real person without explicit permission, even without stating their name.

7.1The user owns the rights in the outputs created through their account, subject to the law.

7.2Automated outputs based on artificial intelligence are not necessarily protected by copyright under Israeli law.

7.3The user may use the outputs, including for commercial use, but without obtaining exclusive copyright.

7.4The Site may create outputs similar to the outputs of other users.

7.5Responsibility for any resemblance to a person, brand or existing work lies with the user alone.

7.6The user is responsible for making sure the outputs do not infringe third-party rights.

7.7The Business does not make public use of outputs without explicit consent.

7.8The Business may run automated checks for security purposes and to improve the service.

8.1The Business may transfer personal or operational information to third parties that provide services to the Site, including technology providers, artificial intelligence providers, cloud, storage, payment-processing and infrastructure services, solely for providing, operating, securing and improving the service, and in accordance with the law.

8.2Credit card details are not stored on the Site.

8.3The Site is secured by accepted means, but there is no absolute immunity from cyber attacks.

9.1The service is provided as is, without any commitment to availability or to a particular result.

9.2The Business will not be liable for direct or indirect damage, including business losses or harm to reputation.

9.3Use of the Site and of the outputs is at the user’s sole responsibility.

9.4Liability is capped at the amount the user paid in the last 12 months.

The user undertakes to indemnify the Business for any damage or claim arising from a breach of these terms or prohibited use of the Site.

11.1The Business may suspend or close an account because of a breach of the terms.

11.2The user may request the deletion of their account, subject to the law.

11.3The Business may delete data from an inactive account.

12.1The Business may update these terms at any time.

12.2Continued use of the Site constitutes acceptance of the updated terms.

13.1These terms are governed by Israeli law only.

13.2Exclusive jurisdiction lies with the competent court in the city of Ramla, Israel.
